1 - The Cirano Service
Cirano is a relationship intelligence platform that connects to platforms you choose, retrieves your own data locally on your device, and generates visual behavioral insights for your personal use — without ever sending your data anywhere. Your data stays on your device. Your insights belong to you.
Read-Only by Design: Cirano is a mirror, not a messenger. It reads your data locally to reflect what is already there. It does not allow you to send, reply to, or interact with any connected platform from within the App. Cirano observes. It never acts.
2 - Your Cirano Account and Responsibilities
Account Creation. You must create a Cirano account before accessing and using Cirano. Account creation requires an email address, which is stored securely on Cirano's servers solely for account management purposes.
Your Responsibilities. You agree as follows:
Your right to access and use Cirano is personal to you, and you may not allow anyone else to access your Cirano account.
You represent to us that you are the owner of each of the connected platform accounts you choose to link to Cirano.
You may not use any automated tools or methods (i) to access, acquire, copy, or monitor Cirano or any portion of Cirano; (ii) to interfere with the proper working of Cirano; or (iii) attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of Cirano.
We may suspend your Cirano account or stop providing the Service to you if we suspect you are committing fraud or engaging in illegal activity.
Deleting Your Account. You may request to delete your Cirano account at any time, for any reason, by going to the designated section within the App or by contacting us at support@cirano.us. Upon account deletion, your email address and any associated account data will be permanently removed from our servers, and all data and derived statistics stored on your device will be immediately and permanently erased. Deleting the App from your device is sufficient to permanently remove all personal data. It was only ever yours to begin with.
3 - Data, Privacy, and Security
Privacy Policy: Your use of Cirano is also governed by our Privacy Policy, which details the specific information we collect (including your email address for account management), how your personal data is processed on-device, our commitment to not sharing or selling your data, and your rights concerning your personal information. The Privacy Policy is available at https://www.cirano.us/privacy-policy and within the App.
4 - Subscriptions and Billing
Subscription Plans. Cirano offers auto-renewing subscription plans that provide access to premium features within the App. Subscription pricing and available plans are displayed in the App prior to purchase.
Billing. Subscriptions are billed through Apple (App Store). Payment will be charged to your Apple ID at confirmation of purchase. All billing is handled exclusively by Apple and is subject to their terms and policies.
Auto-Renewal. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. The renewal charge will be the same as the original subscription price unless we notify you otherwise in advance.
Cancellation. You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period.
Refunds. All subscription purchases are final and non-refundable except where required by applicable law or Apple's refund policies. If Cirano terminates your account without cause, you will be entitled to a prorated refund of any prepaid subscription fees for the unused portion of your current billing period, processed through Apple as applicable.
Free Trials. Cirano offers a 7-day free trial for new subscribers. The trial duration and post-trial pricing will be clearly disclosed prior to purchase. Your subscription will automatically convert to a paid subscription at the end of the 7-day trial unless you cancel before the trial period ends.
Data After Cancellation. If you cancel your subscription but do not delete the App, your existing data and insights will remain on your device and will continue to be accessible. However, the App will no longer retrieve or process new data after your cancellation date. Your RelationShape and insights will reflect your data from the date of initial download through your cancellation date only.
Price Changes. We may change subscription pricing at any time. We will notify you in advance of any price changes through the App or other communications. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
5 - Intellectual Property
Ownership. The App, including all content, features, functionality, and visual elements such as RelationShape, are owned by Cirano and protected by applicable intellectual property laws. The name "Cirano" and the Cirano logo are trademarks of Cirano and may not be used without our prior written consent.
Your License. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable laws prohibit these restrictions.
6 - Use on Your Mobile Device
Cirano requires you to download, install, and maintain a mobile application on a compatible mobile device. You are solely responsible for any requirements, updates, and fees from your device or telecommunications provider. WE MAKE NO EXPRESS, STATUTORY, OR IMPLIED WARRANTIES OR REPRESENTATIONS OF ANY KIND AS TO: (i) THE AVAILABILITY OF TELECOMMUNICATION SERVICES TO ACCESS AND USE CIRANO; (ii) ANY LOSS, DAMAGE, OR SECURITY INTRUSION OF THE TELECOMMUNICATION SERVICES OR YOUR DEVICE; AND (iii) ANY FAILURE TO TRANSMIT ANY DATA OR SETTINGS CONNECTED WITH CIRANO.
7 - Disclaimer of Warranties
THE APP IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CIRANO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CIRANO DOES NOT WARRANT THAT THE RELATIONSHIP INSIGHTS AND ANALYTICS GENERATED BY THE APP WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
8 - Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CIRANO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO CIRANO FOR THE USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
9 - Changes to Cirano and These Terms
We may add, remove, or change functionality within Cirano at any time to improve the Service. We may also modify these Terms from time to time. If changes are material, we will notify you through the App or other communications. By continuing to use Cirano after we have notified you, you agree to be bound by the new Terms. You have the right to object to any changes by canceling your subscription and ceasing your use of Cirano.
10 - Term and Termination
We may suspend or terminate your Cirano account and rights to use the Service immediately if you violate these Terms or for any reason at our sole discretion. Upon termination, your right to access and use Cirano will terminate immediately. If we terminate your account without cause, you will be entitled to a prorated refund of any prepaid subscription fees for the unused portion of your current billing period, processed through Apple as applicable.
11 - Dispute Resolution and Arbitration
Informal Resolution. Before initiating any formal dispute, you agree to contact us at support@cirano.us and give us 30 days to resolve the issue informally.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. This means you and Cirano agree to resolve disputes individually and not as part of a class action or group claim.
Opt-Out. You may opt out of this arbitration agreement by contacting us at support@cirano.us within 30 days of first using the App. Your opt-out request must include your name and a clear statement that you wish to opt out of arbitration.
Small Claims Exception. Either party may bring qualifying claims in small claims court instead of arbitration.
Jury Trial Waiver. BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR ABILITY TO PARTICIPATE IN A CLASS ACTION LAWSUIT AGAINST CIRANO.
12 - Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. For any disputes not subject to arbitration, you agree that legal proceedings will be brought exclusively in the courts located in Delaware.
13 - Entire Agreement
These Terms and the Cirano Privacy Policy form the entire agreement between you and us with respect to your Cirano account and your use of the Service.
